These conditions, together with any additional conditions, are the terms and conditions subject to which Almeria Property Auctions (The Closed Bid Agents) as agents for the vendor shall sell property to the purchaser (The bidder) and all other conditions, whether express, or implied at common law, or by status, as are capable of lawful exclusion are hereby excluded. All vendors and purchasers agree to be bound by these conditions and are deemed to have read and have full knowledge of them.

Vendors Terms and Conditions:

1. The vendor warrants to Almeria Property Auctions and to the buyer that he/she/they are the true owner of the property by producing all relevant paperwork contrary to any request made by Almeria Property Auctions.

2. The vendor must complete all sales registration forms.

3. Almeria Property Auctions act throughout as agents only and are not responsible for any default by the purchaser.

4. A vendor who enters their property or properties for a closed bid auction which are an asset of his/her business must disclose to the auctioneer whether or not they are registered for Tax.

5. Vendors must agree a reserve price and agree to sell their property upon receiving a bid above the reserve price, as per contractual sale forms.

6. Commission shall be charged at a rate of 3.5 % or 5000€ which ever is the greater (inclusive of IVA) for all properties.

7. In case there is a dispute with bids entered, Almeria Property Auctions reserves the right to settle the dispute in a fair manner or to re-offer the property.

Buyers Terms and Conditions:

1. The Vendor has the absolute decision which bid to accept, except when there has been only one successful bid above the reserve price. In case of a dispute, Almeria Property Auctions considers that a dispute has arisen; they have absolute discretion to settle it or re-offer the property.

2. The bidder shall pay to the auctioneer a bid premium of 10€ (inclusive of IVA), this is applicable on each and every bid tendered. This premium is NOT negotiable. This payment will be refunded to the winning bidder.

3. The bidder agrees to have in place prior to set closed bid day a legal representative to carry out conveyance upon successful bid.

4. The winning bidder agrees to pay the reservation deposit (3000€ non refundable) within 24 hours of notification of successful bid.
